Abstract

The article explores how to address innovation-based theories of harm caused by gaps in antitrust's consumer-welfare (CW) standard. It mentions need to demonstrating market power and CW standard requires plaintiffs in monopolization cases brought under Section 2 of the Sherman Act. It also mentions CW standard appropriately allows rule-of-reason judgments to replace per se prohibitions on conduct such as tying and price discrimination.
