Abstract

The article presents U.S. Supreme Court case, "James K. Kahler v. Kansas." where Kansas, U.S. charged petitioner James Kahler with capital murder after he shot and killed four family members. It discusses that, prior to trial, Kahler argued that Kansas's insanity defense violates due process because it permits the State to convict a defendant whose mental illness prevented him from distinguishing right from wrong, along with how Kansas Supreme Court abolished the insanity defense.
