Abstract
- The proposition that doctors find the process of litigation stressful is hardly counter-intuitive. After all, stress is an inherent part of the legal process for any litigant. A doctor's emotional response to the stress of litigation not infrequently manifests itself as anger, hostility and resentment. Although this may be both a natural and an understandable response to an allegation of negligence or professional misconduct, it is hardly conducive to the calm and orderly conduct of a defence case.
