ACCIÓN, CAPACIDAD DE ACCIÓN Y CAPACIDAD DE CULPABILIDAD: PROBLEMAS DE DELIMITACIÓN.

In this paper we aim to define the legal-criminal concept of action, highlighting its internal, subjective dimension. This concept allows to lay bases to differentiate, on the one hand, action from nonaction, and, on the other, absence of action from absence of culpability. There is a dialectical relationship between absence of action and absence of culpability: the more one of them is expanded, the more the other is reduced. We defend the necessary dialogue between criminal law and neuroscience, and, at the same time, we note that scientific advances seem to increase the number of cases of absence of action, and, correspondingly, to reduce the occurrence of hypotheses of absence of culpability.
