Abstract

This paper analyzes and justifies the need for a law proposition of supervision of controlled products, ensuring the police power to the Brazilian Army, in order to improve the control of arms, ammunition and explosives legal and illegal throughout the national territory. This purpose will be achieved through research and study of cases experienced by the system of supervision of controlled products of the army and of the activities carried out by public security organs. The Brazilian Army is the organ which has the best conditions to perform the supervision of controlled products of preventive and repressive way, because as federal institution is present throughout the national territory and with considerable in all effective States of the Federation. It has close links with the other Armed Forces, with all the organs of Public Security and national defense industry and international military attachés in the main Brazilian embassies, which facilitates the relationship between systems of countries intelligence employees in matters of repression of international trafficking in firearms. Thus, it is concluded that the Brazilian Army, has a great capacity to perform a great job for the brazilian society. The monitoring would be of the form already exists, complemented by timely and objective repression, with investigation, prosecution and dismantling of criminal activities linked to crimes involving firearms, explosives, ammunition and other activities that use restricted use and military artifacts, which may cause serious risk to society.
