Abstract

Today, most EU member states have satisfactorily regulated housing issues. In some, the right to housing is a constitutional category (exempli causa, Belgium, Slovenia, Spain, Greece) or is regulated by relevant laws (exempli gratia, France, Denmark, Great Britain, Germany). However, common to all housing policies is that the housing is understood not only as a “roof over your head”, but as a standard of civilization. However, the issue of housing policy for this scope of paper is too complex, temporally and politically-economically and institutionally sensitive topic, and would make it impossible to give final or more specific answers to the questions asked. However, one part of the issue of adequate housing policy is the issue that is regulated in most countries by the laws on housing and maintenance of residential buildings. Thus, as one of the key problems of positive housing regulation is the insufficient or prevailing legal framework that would regulate housing and maintenance of residential buildings, we analyze the provisions of the Draft Law on Management and Maintenance of Buildings.
