The paper analyzes the demand for legal control of the obligations of transnational enterprises to respect human rights through a binding treaty on the matter, such demand shows the need to develop international recognition of models of justice for collective rights articulated to the Eurocentric models of justice in an International Covenant on Collective Rights and Intercultural Justice. An overview of the philosophy of neoliberalism and its influence in Latin America is offered in order to evaluate the most important responses that have been developed both in the United Nations Organization and in the International Labor Organization on the mandatory document for the transnational companies respect human rights.
