Law 21/2013 has developed in detail the legal regime on environmental assessment, putting in place legal requirements to carry out the EIA of projects and the granting of permits proceedings. Relevant case-law from the State Supreme Court, which is being followed by other judicial bodies such as the Supreme Court of Galicia in a case analysed hereby, highlights the importance of the EIA within decision-making processes aimed to granting permits for industrial activities. In this regard, Spanish courts have recognized the nullity of permitting decisions in cases of failure in compliance with the requirements on prior and independent publication and issuing of the Environmental Impact Statement.
