This paper reflects on the consequences of the introduction of neuromarkers in structured risk assessment tools in cases of subjects with personality disorders like psychopathies. Taking into account that neuroimaging studies reveal these subjects present alterations in brain areas in charge of controlling the action, there is a risk that, in line with the expansive current of criminal law of dangerousness, and in attention in the absence of agreement on effective treatment in these cases, the life imprisonment of these people is legitimized.
