Abstract
- Objective: This research aims to analyze the social phenomenon of Cyberbullying and the national public policy to combat and prevent it, in order to assess its effectiveness, especially in times of COVID-19, when most Brazilian schools were forced to adapt its teaching practices for the digital environment and classes started to be taught through the virtual environment. Method: The present study is going to be based on research developed according to the method of deductive approach, historical and comparative procedure and interpretive, exegetical, systematic and critical legal explanation, which is going to be based on national and foreign bibliographic research. Results: As a result, it was found that the existence of a national policy that conceptualizes and characterizes systematic intimidation (Bullying and Cyberbullying), which classifies the social phenomenon and promotes training campaigns for teachers and pedagogical teams and provides guidance to them is fundamental. However, the aforementioned public policy has gaps with regard to the form of treatment that should be given to the violence practiced, as well as to the victim and to those who practice cyberbullying in the school environment. Contributions: This study points to the need of educational institutions to adopt the educational models of Education on Human Rights (HDI), specially, the education of values, socio-emotional education and education for the non-violent resolution of conflicts, as they are models that provide respect for human dignity and that promote values of freedom, justice, equality, solidarity, cooperation, tolerance and peace, as well as implementing online school mediation programs in the ODR perspective, due to the pandemic, as a way to restore and repair the victims, hold the aggressors responsible and solve the social phenomenon of cyberbullying perpetrated in the school environment.
