A SEGURANÇA JURÍDICA COMO MEIO DE PRESTÍGIO ÀS DECISÕES E PREVENÇÃO DE CONFLITO.

The Brazilian Judicial Authorities are facing litigiousness and demands for the prevention of conflicts. Current paper investigates juridical activism in Brazil which scorns at juridical security and the predictability of jurisdiction. It verifies the duty of the magistrate and juridical organs to guarantee juridical security and credibility in its decisions in the wake of signs of activism in the Brazilian jurisdictional exercise. Specific aims comprise the activist behavior in decision taking frequently based on the conveniences of the moment and ideologies of the applier of the Law, cultural filters that corroborate towards the depreciation of the juridical decision and the acceptance of juridical activism in Brazil. Methodology comprises deduction, bibliographical review of articles and doctrine, coupled to the jurisdictional analysis of the theme. The preeminence of the guarantee for juridical security is upheld for the prevention of conflicts and the (limited) feasibility of juridical activism in the Brazilian juridical system.
