LA PANDEMIA Y LA LIBERTAD DE EMPRESA.

The purpose of this paper is to analyze from a constitutional perspective the legal impact of the pandemic on the freedom of enterprise. First, it explains how the Constitutional Court understands this freedom and how it is situated in the context of exceptional states. It then analyzes the erosion suffered by the freedom of enterprise as a result of the measures adopted in the three phases through which the health crisis has passed (and continues to pass).
