Abstract
- The article discusses the Supreme Court's decision in Romag Fasteners versus Fossil and the Lanham Act. It mentions that courts should adopt the Consumer Approach and use trademark remedies to end the modern overprotection of trademarks. It proposes the Consumer Approach to identifying unfair competition and applies it to trademark law. The Consumer Approach empowers courts to preserve a zone of legitimate competition by permitting business activities that benefit consumers.
