Sentencia del Tribunal de Justicia de la Unión Europea, de 2 de marzo de 2023: Polonia ha incumplido las Directivas 92/43, relativa a la conservación de los hábitats naturales y de la fauna y flora silvestres (arts. 6; 12.1; 13.1.a y 16.1); y, 2009/47, relativa a la conservación de las aves (arts. 4. 1, 5 y 9. 1), en conexión con el Convenio de Aarhus, debido a que la legislación de bosques establece que el cumplimiento de las exigencias de buenas prácticas en materia de gestión forestal no vulnera las disposiciones sobre la conservación de recursos, formaciones y componentes naturales y por no garantizar la posibilidad de las asociaciones ambientales de impugnar judicialmente los planes de gestión forestal.

Abstract

The Court of Justice of the European Union has ruled that Poland has failed to comply with Directives 92/43 and 2009/47, related to the conservation of natural habitats, wild fauna and flora, as well as the conservation of birds. Polish forestry legislation does not meet the requirements of good practices in forest management and does not guarantee the possibility for environmental associations to challenge forest management plans. The European Commission filed a lawsuit in 2018 and the Court of Justice has declared that Poland has failed to fulfill the obligations established in the Directives and in the Aarhus Convention. The Court concludes that Poland must ensure the possibility for these organizations to file lawsuits and that national legislation must comply with the requirements of clarity and precision established in environmental law.
