Abstract

Japan’s act of discharging nuclear sewage into the sea does not meet the conditions of consent of the injured state, force majeure and imminent peril under Draft Articles on Responsibility of States for Internationally Wrongful Acts, and therefore does not meet the conditions of exempting the wrongfulness of State acts; meanwhile, the grounds for exemption from state responsibility based on Japanese domestic law and sewage discharge as a private act of Tokyo Electric Power Company cannot absolve Japan of its responsibility. Therefore, Japan must bear certain national responsibilities and obligations under the premise of violating the specific international obligations of United Nations Convention on the Law of the Sea and the Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter.
