Abstract

The article explores the state of consumer data privacy in the U.S. and proposes a comprehensive consumer data privacy law that includes a right to be forgotten that would not violate the First Amendment. It discusses the government regulation of interstate commerce. It analyzes the practice of collecting and selling consumer data as a matter of interstate commerce and the limited protection of the collection and sale of consumer data as commercial speech under the First Amendment.
