Abstract

The article describes a legal dispute regarding the granting of short-time work allowance (Kug) by the Federal Employment Agency. It concerns three employees of a French company who are employed in Germany. The Employment Agency rejected the granting of Kug because the company does not have a business location in Germany. The Social Court dismissed the company's lawsuit, as the German branch of the company is only considered a branch office and not an independent business location. The plaintiff has appealed, but the court has dismissed the lawsuit and determined that the defendant's decision is lawful. The article deals with a legal dispute regarding the granting of short-time work allowance (Kug) in Germany. It is stated that the responsible employment agency may not have had local jurisdiction, as the plaintiff did not have a local reference point. However, the defendant cannot rely on the incompetence of the employment agency, as they themselves decided on the application. It is also determined that the plaintiff does not meet the operational requirements for the granting of Kug, as they do not have an independent operational part. The court concludes that the plaintiff does not have a clear and permanent separation of their sales department from the overall operation and therefore has no entitlement to Kug.
