Sentencia del Tribunal de Justicia de la Unión Europea, de 21 de septiembre de 2023: Alemania ha incumplido la Directiva 92/43, relativa a la conservación de los hábitats naturales y de la fauna y flora silvestres (arts. 4.4 y 6.1) por no haber declarado numerosos Lugares de interés Comunitario (LIC) como Zonas especiales de Conservación (ZEC) ni haber fijado las medidas y los objetivos de conservación correspondientes.

Abstract

The Court of Justice of the European Union has ruled that Germany has failed to comply with Directive 92/43 on the conservation of natural habitats and wild fauna and flora by not declaring numerous Sites of Community Importance (SCI) as Special Areas of Conservation (SAC) or establishing the corresponding conservation measures and objectives. The European Commission filed a lawsuit claiming that Germany had not designated 88 out of the 4,606 designated SCIs as SACs and that sufficient conservation measures had not been adopted in another 737 SCIs.
