Abstract
- This article discusses the current landscape of biometric privacy rights and the litigation associated with these issues. In the United States, the regulation of biometrics falls on the states, as there is no federal privacy law. Currently, there are only three dedicated biometric privacy statutes in the US: the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and the Washington Biometric Privacy Act (WBPA). The BIPA is the only law with a private right of action. The article also explores trends in biometric litigation, such as the use of telematics in transportation and virtual try-on technology in retail. It also discusses the integration of biometrics with emerging technologies like artificial intelligence and the metaverse. [Extracted from the article]
