Abstract

The article describes a competition dispute over the appointment of a position in the Bundeswehr (German Armed Forces). A professional soldier and staff officer has applied for preliminary legal protection, as he believes that he meets the requirements for the position. The Federal Administrative Court has overturned the selection decision and obliged the Federal Ministry of Defense to make a new decision. It is emphasized that changes to the requirements profile in an ongoing selection process constitute the termination of the previous process and require a valid reason, which must be documented. The duty of the employer to provide information and documentation is also mentioned, in order to give applicants the opportunity to review their rights and, if necessary, seek legal protection.
