Abstract

The article discusses a case in which the European Court of Human Rights (ECtHR) considered whether the lack of legal recognition and protection for same-sex couples in Poland violated Article 8 of the European Convention on Human Rights (ECHR). The court ruled that Poland had failed to comply with its positive obligation to ensure legal recognition and protection for same-sex unions, thereby violating the right to private and family life and engaging in indirect discrimination based on sexual orientation. The ruling has implications for all member states of the Council of Europe and highlights the importance of the ECtHR in advancing same-sex rights. [Extracted from the article]
