Abstract

The article provides an overview of removal defense in immigration law. Removal defense refers to the legal process by which immigrants facing deportation or removal from a country seek to delay or prevent this from happening by litigating their case in federal immigration court with the help of legal representation. Immigration defense lawyers present arguments as to why the individual should be allowed to remain in the country, which can include arguments related to asylum, cancellation of removal, withholding of removal, and protection under the Convention Against Torture. The article also highlights the unique considerations and protections for children in removal proceedings, as well as the impact of criminal convictions and detention protocols on both children and adults.
