Abstract: This paper will examine current approaches to mental incapacity and how these views have altered since the 1920s. Does a statutory definition of 'a person without capacity' add anything to rthe existing common law and what are relevant criteria to be taken into account when decisions are taken on behalf of an incompetent adult.
