Abstract

Genetic testing can be used in family law cases to determine paternity, which is the legal identification of a child’s biological father. Once the test is completed, the results can be used to establish or disprove paternity and determine legal obligations such as child support or custody arrangements. While scientific innovation offers this possibility, there may be several other factors and questions that courts have to consider. Addressing such factors is even more challenging when it is concerned with the privacy of children. This case note considers the 2023 decision of the Supreme Court of India in <italic>Aparna Ajinkya Firodia v Ajinkya Arun Firodia</italic>, which is a milestone regarding the privacy of children in paternity cases. It also considers the need for law to address factors such as the wishes and the free informed consent of the child, while weighing considerations of privacy and the potential of genetic technologies.
