Abstract
- The article reports on the impact of the decline in courtroom trials since the 1980's. The reasons for the decline are explored, including the threat of huge jury verdicts in civil cases and strict federal sentencing guidelines in criminal cases that often lead to plea deals and settling out of court. Moreover, the cost of litigation is intimidating to many plaintiffs. Some judges are concerned that the basic right to a trial by jury is being diminished and lawyers do not have opportunities to practice their courtroom skills. As a result, many lawyers are finding creative ways to find trial work, such as offering to donate associate time in exchange for referrals of cases that seem likely to go to trial.
