Abstract
- The article examines the interaction of several powers related to the conduct of war. Theories about the interaction of the U.S. Commander in Chief Clause and Congress's war regulatory powers, are discussed. The controversy over the famous Bybee memorandum is analyzed, as well as the sentiments of the critics of the Bybee memorandum regarding the scope of the executive authority of the U.S. president regarding the advance and retreat of soldiers.
