Abstract
- The article comments on the conventional wisdom that impeachment is the sole remedy to remove a federal judge from the position and that its implicit reference is the constitution's grant of good-behavior tenure. The authors argue that the impeachment-only argument has no basis either in the constitutional text or in the history behind that text. They provide construction to the Good Behavior Clause in Article III of the U.S. Constitution.
