The article presents a case of an employment agreement between Honduran native Dilbert Ivan Calix-Chacon, plaintiff, and defendant Global International Marine, a U.S. Corporation. Calix-Chacon was diagnosed to have inflamed gall bladder and an enlarge heart which require immediate attention. The court invalidates a forum selection clause on the employment contract of seaman to determine whether it is an exceptional case or unenforceable.
