Abstract

The Law has been an issue in mexican transition to democracy. The strenght of the old Mexican Political System (PRI System) was based on a hierarchical but flexible form of political inclusion. This form of inclusion allowed the old system to negotiate with different social and political groups. Today´s democratic system is less flexible to deal with those groups.The paper analyzes the way arbirtrary authorithies, on one hand and abstract and legal system, on the other deals with pluralism. The old PRI System was based on arbitrary authorithies and an arbitrary use of law that alowed it to deal with some social groups. Paradoxicaly the newly democratic regimen is having some problems with some social identities. The social and political inclusion throughout citizenship is insufficient to recognize those identities. The old discourse of the Mexican Revolution used the time as a way to incorporate workers, indians and peasents. They were somebody in today´s politics because they were somebody tomorrow. Politics was not the dispute of today but the dispute of tomorrow, they accepted the rules of the game today, because they have something to care tomorrow. But the newly democratic system is unable to deal with this form of politics, it can not offer time it is a society organized throughout space, throughout rights and responsabilities. The authorithies are less arbitrary but more limited to recognize plurality.The paper is not an apology of the old Mexican regime, but is an attempt to explain the strenght of the old PRI regime and the obstacles of the newly democratic regime and is also an oportunity to discuss how plural could be modern democracy. ..PAT.-Unpublished Manuscript [ABSTRACT FROM AUTHOR]
