Abstract

This paper will discuss some of the theoretical reasons why religion has largely been absent in analyses of the role of law in a globalising world, and more specifically of the expansion of mechanisms of dispute management under processes of globalisation. The paper will discuss some of the contradictions and paradoxes that emerge out of different perspectives on globalisation. A number of theoretical strands will be discussed in conjunction: debates about alternative dispute resolution, debates about the increasing importance of religion, and the debate about increasing juridification. It will be argued that the reluctance to take religion into account and a general tendency to see religion primarily as a source of conflict has led to a skewed view on developments in dispute management and juridification. ..PAT.-Unpublished Manuscript [ABSTRACT FROM AUTHOR]
