Abstract
- The article focuses on the decision made by the U.S. District Court on the case between Jim Smith and Paul Green School of Rock Music on its ten-years franchise agreement. The court stated the franchise agreement has contained aspects suggesting procedural unconscionability. He adds that the presence of procedural unconscionability alone was insufficient to defeat the enforcement of the arbitration clause using the sliding scale test.
