COLOMBIA CON TOGA: UNA APUESTA POR EL NEOCONSTITUCIONALISMO EN EL ESTADO NACIONAL.

The neoconstitutionalism doctrine draws itself as one of the most controversial and debatable law theories of our times. Renewing the discussion between formalism and antiformalism, the exponents of this school have spent deep investigations in its academic development, in order to reintegrate forgotten moral imperatives to the juridical practice. The following essay represents another reinforcement to the debate, taking into account that its purpose is to demonstrate the accurate lodging between the neoconstitutionalism statements and the Colombian juridical lacks, defending a contentious thesis: the national state, specially in constitutional and judicial terms, condensates many traits that belongs to that neoconstitutionalism spectrum.
