Abstract
- The article discusses how the courts use the doctrine of procedural unconscionability in voiding valid contracts formed over the Internet. The clickwrap and the browsewrap agreement are used in contract agreements in the Internet where assent to the contract is done through a click of a button. It concludes that this process is an efficient tool for e-commerce but can be vulnerable to procedural unconscionability and can be avoided by reformatting the terms of the agreement.
