Rule 26 to Change.

The article focuses on the proposed amendments of Rule 26 of the Federal Rule of Civil Procedure concerning the expert witness' draft reports and communications with the lawyer. An overview of the old rule is provided, along with the problems inherent in the rule with respect to expert testimony. Under the proposed changes, draft expert reports in court proceedings will be safeguarded from disclosure in all federal cases, and the protection extends to attorney-expert communications.
