Abstract

This paper inquires whether it is possible to export liberal democracy to countries which do not share a tradition based on the individual. Although usually considered as part of the Western democratic tradition, a socio-legal analysis of the Greek Constitution will reveal how the French model which has inspired it has been altered to the detriment of fundamental liberties and rights. A mistaken conception of the relationship between State and Church appears as crucial in the politicization and secularization of the Church and in the creation of a religious, "believing State". The lack of separation between Church and State shows the Greek incongruence of two co-existing drives: a) westernization; b) loyalty to the Orthodox tradition of pre-modern, community- and family-oriented values. In conclusion the displacement of Western constitutional models has resulted in a clash between the liberal concept of individual and the Christian concept of persona. ..PAT.-Unpublished Manuscript [ABSTRACT FROM AUTHOR]
