Abstract

This paper will connect a series of issues in property law with open questions from the literature about the psychology of home and place. As one example, the paper connects a series of legal issues relating to the possession of homes - including rent control, rights of redemption in foreclosure, and the taking of homes through eminent domain - with the psychological literature on the impact of displacement on homeowners. Legal scholars writing in these areas have often made questionable assumptions about the psychological relationship between people, place and home. Even in those instances where legal scholars have sought guidance from work on the psychology of place, they have been hampered by the absence of relevant literature or ambiguity in the literature that does exist.
