Abstract
- The article focuses on the process of removing jurors based on their view of capital punishment in the U.S., referred to as "death-qualification." The authors examine how the death-qualification process arose, why the U.S. Supreme Court continues to justify its existence and how a proper understanding of the Sixth Amendment right to a jury trial requires the end of the process. They conclude that death qualification deprives a dependant of what the Constitution guarantees.
