Abstract

The article discusses the legal aspects of terrorism as defined by the U.S. federal criminal law and the international laws of war. It states that the existing principles and doctrines of the country's federal criminal law as well as the international laws of war cannot fully address the nature of the terrorist threat. It says that one framework at defining the threat of terrorism primarily focused on the prosecution and punishment of individuals for their alleged terrorist activities. Furthermore, it notes that the criminal and military models each provide insights into the nature of the terrorist threat, identifying particular aspects of the problem that most closely resemble their respective paradigms.
