Abstract

The article discusses the patenting of stem cells in the U.S. and Europe. It is stated the patent applications made by the Wisconsin Alumni Research Foundation (WARF) in the U.S. and by the European Patent Office (EPO) were questioned due to its effect on human health. It mentions that the patent system of WARF shows a reasonably level in the field of technology for its comprehensive criteria for the grant of monopoly rights of exploitation in the area of stem cell technology. On the other hand, the patent system of EPO shows poor quality in attaining the required standards in patenting and assessing inventions.
