Abstract

The United Nations Convention on the Rights of the Child is an international treaty that grants all children a comprehensive set of rights. These include the right of every child to a standard of living adequate for the child's physical, mental, spiritual, moral and social development. An elementary part of the standard of living is child care and protection. The Republic of Croatia, as a Party to the Convention, is obligated to take all appropriate measures to secure the recovery of maintenance for the child; to undertake all appropriate legislative, administrative, and other measures for the implementation of recognized right and guarantee the child such protection and care as is necessary for his or her well-being. The paper analyzes the system of child maintenance in Croatian Family Law in accordance with the state's responsibility to ensure efficient protection and exercise child's right to maintenance. The paper also analyzes the new provisions of the Family Law Act intended to improve and simplify the procedure of exercising the child's rights to maintenance through courts and thus to provide better efficiency in the realization of this right.
