Criminal Offence of Environmental Pollution.

In this paper the criminal offence of environmental pollution is being analyzed as the most significant offence from the group of criminal offences against the environment in our Criminal Code. In introductory remarks, the author points to the necessity of comprehensive criminal law protection of the environment, and lists arguments to support this claim. The second part of the paper provides an analysis of the group of criminal offences against the environment, as well as the object protected by this group of criminal offences. In the third, central part of this scholarly paper, the author examines the crucial elements of the legal concept of the principal, as well as, the grave form of the criminal offence of environmental pollution. At the same time, the author points to the imprecise legal definition of this criminal offence and to the problems that, as a result, occur in the criminal law theory and judicial practice, while offering his suggestions for solving these problems.
