Abstract: In spite of the support of economics, the constitution of International Work Organization sustains that "work is not ware", and because of this, work is not exposed to legal settlement regarding competition. Market economy implies the existence of two different entities, of two social partners as it follows: on one hand we have the patronized, representing the capital and the employees who are organized or unorganized in unions and on the other hand representing work force.
