Abstract

The article offers the author's insights on the issue of human rights on the expertise provided by Fundamental Rights Agency Legal Experts (FRALEX) to European Union (EU) Fundamental Rights Agency (FRA) on the study "Homophobia and discrimination on grounds of sexual orientation in the EU member states." The author says that the legal analysis of study has been drafted by the legal experts group FRALEX, which provided the background materials on legal issues. He is critical on who takes the responsibility for study on homophobia, either FRALEX or Oliver de Schutter. He also points out that the study has no impact if members of FRALEX have the responsibility in publishing it and there will be confusion between expertise and advocacy.
