Abstract

The article discusses a scenario where a university student is arrested when the police found a bag of illegal drug in the apartment which he shares with two other students, the process of fair trial and the criminal justice system in Australia. It focuses on the right of an individual to be presumed innocent, unless a witness gives evidence of his guilt. It explores the possibility that an innocent person is convicted of a crime when the onus of proof is reversed by the court.
