Abstract

In this article the author explores what happens to an individual's online property when they die. He notes that an increasing number of individuals are having to deal with taking care of the digital belongings of a deceased loved one, arguing that existing laws are too vague about who controls an individual's online property. Proposed legislation by U.S. senator John Wightmann of Nebraska that would give a will's executor automatic access to someone's social media accounts is discussed.
