Abstract

The article discusses the choice of law doctrine and the scope of liability under the U.S. Alien Tort Statute (ATS) in the wake of the U.S. Court of Appeals for the Second Circuit's 2010 ruling in the corporate liability case Kiobel v. Royal Dutch Petroleum Co. A historical overview of the ATS is presented, including information on the original jurisdiction of district courts in civil cases adjudicated in America. An interlocutory appeal under Title 28, Section 1292(b) of the U.S. Code is also examined.
