Abstract
- The article analyzes pre-service removal under the plain language of the forum defendant rule that prohibits removal based on diversity jurisdiction. It addresses the split among the district courts of the U.S. regarding different interpretations of the forum defendant rule and examines the general removal doctrine, general principles of statutory interpretation, and the history of the absurd-result principle of court regarding forum defendant rule. It discusses why plain language argument in favor of pre-service removal is the appropriate resolution of the district court split.
