Abstract

The thesis of the present paper is to support that the lack of continuity on public policies has affected the legal application of the legitimate expectations principle, which often is considered such as the best tool in order to solve, through relocation, the tension between public space protection and the right to work entitled to the peddlers and itinerant vendors. Because of that, on the following text there is a call for reflection directed to the state (legislators, local governors and judges) and to the citizens, in order to rethink the meaning of the above mentioned principle and its scope as well as in establishing the right way of applying it; a right way to the tension among rights, instead of looking forward particular benefits (even abusing of the good faith principle), from the uncertainty that generates disparity of public policies.
