DERECHO DE PROPIEDAD Y ORDENANZAS LOCALES: PRECISIONES ACTUALES SOBRE EL FUNDAMENTO, ALCANCE E INTENSIDAD DE LAS NORMAS LOCALES EN ESTA MATERIA.

Thi s paper analyzes the intervention of the local Ordinances in the right of private property. A reflection is realized about the scope of the normative power of the local Governments in this matter. Taking into consideration the flexible concept of the principle of legal reservation in this field (art. 33 CE), it is a question of formulating the canon about local normative power, according to the space that in the praxis corresponds to these local norms. For it, there is an analysis the solutions that support in different sectors the courts, which control the local Ordinances that concern the right of property. It is verified that not always they support the same canon. As a final conclusion, it is offered a doctrinal explanation of this different jurisprudential treatment. [ABSTRACT FROM AUTHOR]
