REVISIÓN DE LA DOCTRINA JUDICIAL EN MATERIA DE DESPIDOS COLECTIVOS.

The labour reform introduced in 2012 by Royal Decree Law 3/2012 of 10 February and by Law 3/2012 of 6 July signified the beginning of a profound review of the collective dismissals regime. This paper is intended to provide a general overview of the recent judicial decisions on this matter, focusing mainly on those issues that have generated the most controversy to date: (i) group of companies; (ii) the documents necessary in the collective dismissals procedure; (iii) the need to act in good faith during the consultation period; and, (iv) the objective causes justifying the collective dismissal.
